Rules of buying and selling goods

  1. Terms used in the rules
  1. The data controller and operator of the website www.lt (hereinafter – Data Controller and Seller) is MB “Mapa baldai”, company code 305959656, VAT LT100015081718, email address – info@mapabaldai.lt.
  2. Buyer – a natural or legal person who has purchased goods from the online store https://mapabaldai.lt/.
  3. The goods purchase-sale rules (hereinafter – Rules) regulate the rights, obligations, prices, payment procedures, delivery, quality guarantee, returns, exchanges, and liabilities of the Buyer and the Seller.
  1. Terms and conditions
  1. These Goods Purchase – Sale Rules (hereinafter “Rules”), upon approval by the Buyer (after reading the Rules and marking the box next to the statement “I have read the Mapa baldai purchase rules and agree with them”), become a binding legal document for both parties, setting out the rights and obligations of the Buyer and the Seller, conditions for purchasing and payment for the Goods, delivery and return procedures, the parties’ liabilities, and other provisions related to the purchase and sale of Goods in the online store.
  2. The Seller reserves the right to change, correct, or supplement the Rules at any time, in accordance with legal requirements.
  3. By confirming the Rules, the Buyer confirms that they have the right to purchase Goods in the Mapa baldai online store.
  4. Additionally, we inform you that these Rules may be amended if legal regulations change. Every time making a purchase, we recommend reviewing the Rules to ensure that the Buyer fully understands the conditions under which the order will be placed.
  5. The Buyer must familiarize themselves with the Privacy Policy approved by the Seller. Consent or objection to specific uses of the Buyer’s personal data is expressed in the manner provided in the Privacy Policy.
  6. If the Seller is required to send documents or information to the Buyer by email, the Buyer is responsible for providing the correct and active email address.
  1. Privacy Policy
  1. MB “Mapa baldai”, conducting e-commerce, follows the Lithuanian Personal Data Legal Protection Act, the General Data Protection Regulation (EU) 2016/679, and other legal acts governing the processing, storage, and enforcement of personal data.
  2. The Privacy Policy is an integral part of the Rules.
  1. Goods
  1. The images of Goods presented in the online store are for illustrative purposes. Despite the Seller’s efforts to display the colors of Goods as accurately as possible, the Seller cannot guarantee that the Buyer’s device screen will accurately reflect the colors of the Goods. The Buyer understands that the Goods may differ slightly from their images.
  2. The packaging of the Goods may differ from that shown in the images in the online store.
  3. All Goods presented in the online store are available to the Buyer. If the ordered Goods are no longer in stock, the Buyer will be immediately notified via email or other means (call and/or SMS), and the order for such Goods will be canceled.
  4. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer selects the Goods to purchase and presses the “Order” link, and when the Seller contacts the Buyer by phone or email to confirm the order by sending an email confirming the order.
  5. Every purchase-sale contract concluded between the Buyer and the Seller is registered and stored in the online store’s database.
  1. Buyer’s Rights
  1. The Buyer has the right to view their personal data and request corrections to any incorrect, incomplete, or inaccurate personal data by sending an email to info@mapafurniture.lt. In this case, the Seller must immediately implement the Buyer’s request (within 1-2 working days).
  2. The Buyer has the right to withdraw from the purchase-sale contract only if the Goods are not damaged, their appearance has not changed, and they have not been used and remain in the original packaging.
  3. If the Buyer purchases a defective Product from the Mapa baldai online store, they have the right to: 1) request the Seller to repair the defect free of charge, 2) request the Seller to replace the defective Product with one of proper quality, 3) request a price reduction from the Seller, 4) unilaterally terminate the contract and request a refund.
  4. If the Buyer purchases furniture of inadequate quality, they have the right to ask the Seller to replace the Product with one of proper quality. The Product will only be exchanged with the Seller’s consent.
  1. Buyer’s Obligations
  1. The Buyer must pay for the Goods and accept them in accordance with the procedures set out in these Rules.
  2. If the Buyer’s order form details change, they must immediately inform the Seller.
  3. When using the Mapa baldai online store, the Buyer agrees to follow these Rules, other conditions clearly indicated in the online store, and to comply with the laws of the Republic of Lithuania.
  1. Seller’s Rights
  1. The Seller has the right to set a minimum order amount, i.e., the minimum sum needed to process the Buyer’s order. The minimum sum is visible when reviewing the shopping cart.
  2. If the Buyer tries to disrupt the stability or security of the online store or violates their obligations, the Seller has the right to immediately restrict or suspend the Buyer’s ability to use the online store or, in exceptional cases, cancel the Buyer’s registration.
  3. Due to important circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.
  4. The Seller has the right to cancel the Buyer’s order without prior notice if the Buyer, opting for bank transfer payment, fails to pay for the Goods.
  5. If the Seller is unable to fulfill an order on time and as required due to important reasons, they reserve the right to change the delivery conditions and time or cancel the order, notifying the Buyer and refunding the payment.
  1. Seller’s Obligations
  1. The Seller undertakes to provide the Buyer with access to the services offered by the online store https://mapabaldai.lt/ under the conditions set in these Rules and the online store.
  2. The Seller undertakes to respect the Buyer’s right to privacy regarding their personal information, i.e., to process the Buyer’s personal data according to the laws of the Republic of Lithuania.
  3. The Seller undertakes to deliver the Goods ordered by the Buyer to the address specified by the Buyer under the specified conditions.
  4. If the Seller is unable to deliver the ordered Goods due to important circumstances, they undertake to offer a similar or as close as possible substitute Product. If the Buyer refuses to accept the similar Product, the Seller undertakes to refund the Buyer’s payment within 3 (three) working days, if an advance payment was made.
  1. Goods Prices, Payment Procedures, and Terms
  1. The prices of Goods in the online store and in the order summary are stated in euros.
  2. The Buyer pays for the Goods using electronic banking.
  3. The Seller reserves the right to require the Buyer to sign a Goods order agreement.
  4. VAT invoices indicate the selected Goods, their quantity, discounts, final price including all taxes, and other details required by accounting regulations.
  1. Delivery of Goods
  1. When ordering Goods, the Buyer may choose the method of delivery, i.e., use the Seller’s goods delivery service.
  1. Delivery of Goods to the Buyer’s Specified Address:
  1. When ordering, the Buyer must provide the exact delivery address.
  2. The Buyer is obligated to accept the Goods themselves. If they are unable to accept the Goods, and the Goods are delivered to the provided address and based on other information provided by the Buyer, the Buyer does not have the right to claim the Goods were delivered to the wrong recipient.
  3. The Goods are delivered by the Seller or its authorized representative.
  4. The delivery price depends on the delivery method chosen by the Buyer.
  5. The ordered Goods must be collected no later than 20 working days from the date of the Seller’s confirmation that the order is ready. If the Buyer does not collect the Goods on time, the Seller has the right to cancel the order without warning and refund the payment.
  6. Only the person who placed the order or a person specified at the time of order placement may collect the Goods.
  7. The Seller will deliver the Goods to the Buyer according to the delivery terms indicated in the Goods description. These terms are approximate and do not apply when the required Goods are not available in the Seller’s warehouse, and the Buyer is informed of the shortage of the ordered Goods. The Buyer agrees that in exceptional cases, delivery may be delayed due to unforeseen circumstances beyond the Seller’s control. In such cases, the Seller is obligated to contact the Buyer immediately and agree on new delivery terms.
  8. In any case, the Seller is exempt from liability for delays in delivery if the Goods are not delivered or delivered late due to the Buyer’s fault or circumstances beyond the Buyer’s control.
  9. When receiving the Goods, the Buyer must inspect the condition of the shipment and the Goods, and sign the delivery-receipt document. If the shipment is signed by the Buyer, it is considered accepted in good condition, without any visible damage or discrepancies that can be identified upon external inspection of the Goods.
  1. Return and Exchange of Goods
  1. The Seller has the right to refuse to accept Goods if their packaging (appearance) has changed.
  2. The Buyer has the right to return Goods within 14 days from the date of receipt if their packaging and/or appearance is not damaged, after informing the Seller in writing.
  3. Defective or damaged Goods may only be replaced by the Seller with new ones if the packaging of the Goods remains intact.
  4. Custom-made Goods are non-returnable and non-exchangeable.
  5. The Seller is not responsible for the deterioration of the Goods if the Buyer or persons to whom the Buyer transferred the Goods used them for purposes other than those for which such Goods are typically used, did not follow the instructions, violated the rules for transporting, storing, using, or warehousing the Goods, or if external defects are not recorded in writing during the transfer of the Goods.
  1. Liability
  1. The Buyer is fully responsible for the accuracy of the personal data they provide. If the Buyer does not provide accurate personal data, the Seller is not responsible for the consequences and has the right to demand compensation for any direct losses.
  2. The Buyer is responsible for actions taken using this online store.
  3. The Seller is exempt from any liability if losses arise because the Buyer, despite the Seller’s recommendations and obligations, did not familiarize themselves with these Rules, even though they were given the opportunity to do so.
  4. If the Seller’s online store contains links to websites of other companies, organizations, or individuals, the Seller is not responsible for the information or activities on those sites, does not monitor them, and does not represent those companies or individuals.
  1. Exchange of Information
  1. The Seller sends all notifications to the Buyer’s email address provided in the order.
  2. The Buyer sends all notifications and inquiries to the contact methods provided in the “Contact” section of the Seller’s online store.
  3. The term “in writing” includes emails.
  1. Final Provisions
  1. These rules are created in accordance with the laws of the Republic of Lithuania.
  2. Lithuanian law applies to the relations arising from these rules.
  3. Any disputes arising from the implementation of these rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the laws of Lithuania, based on the location of the Seller’s registered office.
  4. The Buyer may not transfer or assign all or part of the rights and obligations arising from these Rules to a third party without the Seller’s written consent.
  5. If the Buyer disagrees with the Seller’s response to the written complaint, the Buyer (consumer) may submit a complaint regarding the purchased Goods to the State Consumer Rights Protection Authority ((Vilniaus g. 25, 01402 Vilnius, email: tarnyba@vvtat.lt, tel. 85 262 67 51, fax: (85) 279 1466, website: www.vvtat.lt)) or fill out a complaint form on the EGS platform (https://ec.europa.eu/odr/).
